Terms and Conditions of Service

1. Eligibility & User Accounts

1.1. You must be at least 18 years of age or possess legal parental/guardian consent to use this platform. Merchants must be authorized representatives of the registered business or commercial establishment.

1.2. You are responsible for safeguarding your credentials, including secret login PINs, OTPs, and Store Cashier Verification PINs. You must immediately notify SuperQR of any unauthorized access or security breach.

2. Merchant Services & Smart QR Standees

2.1. Service Scope: SuperQR provides digital software tools enabling businesses to generate dynamic QR codes, publish digital menus and catalogs, accept dining table orders, reward customer loyalty visit stamps, and direct happy customers to their public Google Business or Justdial listings.

2.2. Menu & Pricing Accuracy: Merchants bear full legal and operational responsibility for the accuracy of food items, allergen warnings, prices, GST compliance, availability, and physical fulfillment of table orders placed through the digital menu.

2.3. Standees & Intellectual Property: Merchants may print SuperQR table and counter QR standees for their registered outlet locations. The QR routing technology, software code, design trademarks, and layout remain the exclusive property of Pogakulas Technologies.

3. Customer Loyalty Stamps & Gifts

3.1. Stamp Issuance: Visit stamps are awarded when a verified customer visits the store and either enters the merchant's Cashier PIN or has a stamp credited by the merchant staff. A mandatory cooldown period (typically 24 hours) applies between consecutive visits to prevent abuse.

3.2. Gift Vouchers & Redemption: Unlocked reward vouchers (e.g. Free Beverage, 20% discount) are redeemable exclusively at the issuing merchant's premises subject to the terms stated on the voucher. Vouchers are non-transferable and cannot be exchanged for cash.

3.3. Anti-Fraud Protection: Any attempt to forge visits, manipulate cashier PINs, or automate stamp accumulation will result in immediate disqualification and account termination.

4. Reviews & Rating Redirection

4.1. SuperQR facilitates genuine customer feedback. For public ratings, our system transparently guides customers to the merchant's external profile on Google Maps / Justdial.

4.2. In compliance with fair business practices and consumer protection guidelines, SuperQR does not pay, incentivize, or purchase artificial 5-star Google reviews. Customer reviews on third-party platforms are governed strictly by the respective terms of Google LLC or Justdial.

5. Subscriptions, Fees & Payments

5.1. Subscription Plans: Premium features (unlimited menu items, digital table QR codes, POS sync, analytics) are billed on an annual recurring basis (e.g. ₹999/year).

5.2. Taxes & Invoicing: All subscription fees are exclusive or inclusive of applicable Goods and Services Tax (GST) as indicated at checkout.

5.3. Cancellation & Refunds: Annual subscriptions provide immediate platform activation. Once activated, subscription fees are non-refundable except where mandated by statutory law.

6. Platform Conduct & Prohibited Activities

You agree not to:

• Upload or serve illegal, defamatory, obscene, or infringing content on digital menus or ad campaigns;
• Attempt to probe, scan, or reverse-engineer the SuperQR codebase, QR APIs, or database architecture;
• Transmit malicious viruses, trojans, or automated web scraping bots;
• Impersonate any other brand, merchant, or individual.

7. Disclaimers & Limitation of Liability

7.1. The platform is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 99.9% uptime, Pogakulas Technologies does not warrant uninterrupted service during unforeseen telecommunication failures, internet outages, or third-party API disruptions (such as Google Maps or SMS gateways).

7.2. To the maximum extent permitted under applicable Indian law, Pogakulas Technologies shall not be liable for any indirect, consequential, punitive, or loss-of-profit damages arising from merchant food fulfillment disputes or customer dining interactions.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of India (including the Information Technology Act, 2000, and the Consumer Protection Act, 2019). Any legal disputes or claims shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India.
